Emma Sadlier, an Associate at Webber Wentzel, was quoted in a recent article in the Saturday Star that confirmed that a South African can be charged with crimen injuria or hate speech and jailed if they make racist comments on social networks like Facebook and Twitter.
Sadlier commented that any posts on social networks are treated exactly the same way as any comments made in any other public forum. She also mentioned that there has been an increase in the number of liability issues due to the ‘online writing revolution’ mainly for two reasons – people believe they are writing ‘anonymously’ and also that they respond in the heat of the moment.
