In a recent article in Business Report, Deirdre Venter, a partner at Webber Wentzel, commented on the proposed amendment of section 64 of the Labour Relations Act. If approved, the amendment would require trade unions to perform ballots before commencing strike action to avoid majority of employees striking due to pressure from the minority.

Venter explained that this proposal would not stop strike action but would make it more difficult for them to ‘embark upon strike action’ and some of the power may be taken away from the unions.
