Oceana loses court battle on what constitutes BEE

Andre Bowley, a partner at Webber Wentzel, was quoted in article on Moneyweb that reported on the fishing group, Oceana losing its dispute with the Department of Agriculture, Forests and Fisheries (Daff) in the Supreme Court of Appeals. Oceana challenged the department’s interpretation of what constitutes black economic empowerment (BEE), specifically regarding the department’s policy on the Transfer of Commercial Fishing Rights.

Bowley commented that this ruling allows organs of state and public entities to disregard the BEE codes when determining qualification criteria for the issuing of licences, concessions or other authorisations and that transformation would be more constricted than planned by the BEE Strategy and the BEE Act.
