Overview

Our Dispute Resolution Practice presents the full ambit of dispute resolution services for the mining industry. We regularly represent top mining houses, multinational petroleum companies, community groups and other interested parties affected by the grant or refusal of mining and prospecting rights and other regulatory and judicial proceedings related to mining and environmental law.

Our work includes advising on and objecting to applications for prospecting, mining, exploration and production rights; compilation of representations, appeals and reviews related to the grant of environmental authorisations under the Environment Conservation Act, 1989 and the National Environmental Management Act, 1998; instituting and defending internal appeals to the Director General in the Department of Mineral Resources ('the DMR') and the Minister of Mineral Resources ('the Minister'); legal relations with traditional communities and customary law; judicial review proceedings against the DMR and the Minister and all associated legal proceedings, including applications for interdicts to prevent the Minister from granting rights (or compelling her to grant rights) as well as attending to access to information applications under the Promotion of Access to Information Act, 2000.
