

Janine Simpson, a partner at Webber Wentzel was recently quoted in an article in Business Day that reported on the emphasis government is placing on public interest versus competition analysis and about concerns that competition policy has become more important than competition law.
Simpson stated that analysing public interest in assessing a merger is not unique but does add another step to the process and that there is unease over the involvement of the political head of the competition authorities. She further stated that a clear separation of power needs to remain.
