SAA deal may lead to more claims

In a recent article in Business Day, Shawn van der Meulen a senior associate and Desmond Rudman a partner at Webber Wentzel, commented on the settlement between South African Airways (SAA) and the Competition Commission with regards to price-fixing and the relevance with regards to pending civil damages claims.

Van der Meulen commented that if the Comair civil claim was successful it would certainly encourage other plaintiffs to claim for damages from anticompetitive activity in cartel cases.

Rudman mentioned that both Europe and SA had a more “conservative approach” to civil claims and less punitive measures in comparison to the US.
