Recent Work

We are able to provide advice in relation to mining regulation, including:

  • Analysing proposed new legislation and regulation and making submissions to Parliament, regulatory bodies and the Constitutional Court;
  • Advice on the interpretation of, and the full implications of, proposed new legislation, as well as existing legislation;
  • Assisting with dealings with government, organs of state and public bodies, including in relation to public procurement, access to information, administrative decision-making processes; adherence to best practice, and compliance with the Constitution as well as other legislation
  • Advising South African organs of state as well as those of other African governments on measures to improve governance and regulation of natural resources;
  • Advising on international law, including customary international law, international agreements (such as bilateral investment treaties), international trade, non-binding international guidelines (such as the OECD Guidelines for Multinationals) and all aspects of investor-state arbitration
  • Advice on the impact of directives of the World Trade Organisation, different legislative regimes, transnational treaties governing customs duties, international trade incentives and preferential import duties
