The Minister of Forestry, Fisheries and the Environment has amended the transitional arrangements in the National Environmental Management Act (NEMA) Financial Provisioning Regulations, 2015 (FP Regs), for the third time.
Holders of rights and/or permits operating in the mining industry (who applied for them before 20 November 2015) now have until 19 June 2022 to transition to the NEMA regime, bearing in mind that we are expecting the FP Regs to be replaced in their entirety before 19 June 2022.
Although this is a positive development, the market remains desperate for policy certainty and to understand what the final set of replacement regulations will entail.
